Is drug testing in itself an effective means to curtail substance addiction in the work area?

Parents support Drug Testing at schools

Parents of CBC High School students are working for a plan to test their children for drug use. Thursday night they made a closed door meeting between school officials and parents and freshman and many students.

Most parents say they had questions initially, but left very pleased with what they heard. Parents say the meeting addressed most issues they wanted more information about, before supporting the mandatory drug testing plan. If passed, it would begin as early as next year. (continues below...)

School officials say the program is not being considered as a means to address an existing problem. Instead it is considered a means to preventing one.

Some parents say they support the plan overall, but say they would have liked to ask questions during the meeting. Instead they heard a presentation and were told to fill out a survey on the internet. No word when a decision will be made on whether to implement the plan.

Drug Testing Programs for Students at Schools

With due respect to people who are most vigilant about constitutional rights, they fail to win the argument against testing for drug use in public schools. The courts have said such testing is not an infringement, and indeed it would be peculiar to have had rulings to the contrary.

Yet, raising the issue of constitutionality is nearly assured whenever a school district institutes drug testing, as Atherton seems poised to do very soon. Among objections voiced at a school board meeting this week was that of violating Fourth Amendment protection against unwarranted searches and seizures.

Atherton, following similar programs in Grand Blanc, Lake Fenton and Clio, wants to begin random testing of 20 percent of student athletes each month by a company that will be paid $20 to $25 per test, depending on which is selected.

The motivation clearly seems to be protection of the health and safety of the athletes who are exposed to extra danger by virtue of their competitive physical activities, rather than to nab anyone breaking the law. (continues below...)

Nor does the Atherton proposal seem harsh, although details are still under formulation. It reasonably suggests that those who test positive be eliminated from athletics for a limited period, or at least initially submit to drug counseling. Athletic participation is always an option anyway, never mandatory or required as a graduation credit.

Still, imposing mandatory testing is a bold step for a school district, which possibly subjects board members and administrators to criticism and disapproval that most would rather avoid.

But once implemented, the tests are well received. Since Grand Blanc became the first in this area to give the tests - winning a lawsuit along the way that attempted to have the tests ruled illegal - objections have died down to such an extent that only a handful protested to the Atherton board.

Experience has shown that parents, along with the tested students, approve of drug testing as a way to fortify resistance to peer pressures to use drugs, and to help those who are tempted to avoid use. If a student is found using, parents who otherwise might not have even been aware are given a stronger hand for intervention.

Civil rights advocates who still find these programs legally objectionable are encouraged to remain on guard. But so far in this area, there has been no indication of abuse.

Drug Testing Programs at schools

A weekly random drug testing program begins at Vista and Rancho Buena Vista with the help of a three-year federal grant awarded to the Vista Unified School District by the U.S. Department of Education.

This school is the second district in North County which accepts the drug-testing program with government money. The Oceanside Unified School District reinstated its drug testing program this school year at both Oceanside and El Camino after receiving more than $175,000 from the School-Based Student Drug-Testing Program.

Vista's program is suppossed to start in early March with the first-year total grant of $211,000 being divided by the two schools. The amount coming to the district for the second year is $194,846. For the third and final year it's $196,976 for a total of $602,822.

The money may not be used for anything other than the drug testing program for students.

Unlike Oceanside's program, which includes just athletes in its testing pool, any student involved in an extracurricular activity at Vista and Rancho Buena Vista is subject to testing. That includes ASB classes, yearbook, speech and debate, cheerleaders, newspaper, drama, choir, dance, band, internship, work experience, academic team, the AVID program and athletics.

Co-curricular activities, or nonperformance clubs, like the French Club or Latin Club, will not be subject to testing.

Eventually, parents of students outside of the groups to be tested can volunteer their child to be included in the program.Pat Moramarco, the athletic director at Vista, and Dave Whiddon, the athletic director at Rancho Buena Vista, will be the site administrators. Moramarco and Whiddon have both given up two periods as teachers to coordinate their programs.

Each week, 12 students will be randomly selected for testing by Healthworks, which is overseeing the testing and the results. The urine samples will be tested for alcohol, opiates, cocaine, methamphetamines, marijuana and PCP. One or two samples will also be tested for steroids.

"It's a great deterrent,'' Moramarco said. "These days peer pressure is enormous, and it's probably why we need this.

''Students must sign two consent forms ---- one for the test and another for the result to be part of the post-year survey. It will be part of the clearance process before the first practice, along with passing a physical and proof of insurance.

"You simply can't participate in an activity if you don't sign the consent forms,'' Moramarco said.

A first offense will result in counseling for the student, who would remain eligible to participate. Only the student, the school nurse and the parents are notified after a first offense.

The site administrator is notified only after a student fails a second test in the same year. The student receives a five-day suspension. For an athlete, that would include at least one game.

After 30 days, that student must test clean twice before he or she can return to the activity.

A third failed test means the student is ineligible for the remainder of the school year.

Athletes out of season are still subject to testing.

A refusal to submit a urine sample will be considered a negative result.

"I like that it's focused on education,'' Whiddon said. "It's real positive for our campus, especially after the results the football team had.

''The football coaches at Rancho Buena Vista instituted drug testing a year ago. According to head coach Tom Haman, the team will continue its own testing program, as will the Longhorns wrestling and baseball teams. Haman would not say if there had been any offenses on the football team.

Plans are still being worked out as to which days will become testing days.

Early noticeWhen the 2005 All-State Football Team was announced last week by Cal-Hi Sports, sophomore Wally So'oto of Carlsbad was named to the All-State Underclass Team.

What made the selection a bit curious was the fact that the 6-foot, 255-pound linebacker played the entire regular season on the Lancers' junior varsity.

He was called up to the varsity for the postseason run to the CIF Division I title.

"I noticed him in the championship game (at Qualcomm Stadium) and thought he showed a lot of promise,'' said Mark Tennis of Cal-Hi Sports, who helped choose the team.

Drug Testing Kits for Athletes

The league accepted new drug policy and NHL players were subject to random drug testing starting Sunday.

World Anti-Doping Agency president Dick Pound created a stir in November when he claimed as many as a third of NHL players take some form of performance enhancing drugs.

Dallas Stars centre Mike Modano downplayed the significance of random drug testing, saying it was a knee-jerk reaction to the revelation of rampant steroid use in baseball.

"This is kind of the domino effect from baseball that's kind of trickled into the other sports," Modano said Sunday in Montreal where the Stars were preparing for Monday's game against the Canadiens.

"As much as it's floating around in baseball, I think everybody's opinion was that it's probably floating around in other sports, so everybody had to follow suit."

Modano wasn't opposed to increased drug testing because he said the temptation to do everything possible to be at your best is very high as a professional athlete.

"In any sport, there's a lot of expectations to perform at the highest level, and players get desperate and will do anything to keep their jobs and stay in the league," he said. "It depends how far you're willing to take that risk."

Montreal Canadiens defenceman Sheldon Souray thinks testing will help improve public opinion of athletes.
"I know a few years ago we all did random samples, and I think there was less than two per cent where anything showed up," he said. "So it's definitely not a problem in our sport. (continues below...)

"If we can prove that and the public sees that, maybe it will put their minds at ease more than ours."

Toronto Maple Leafs defenceman Bryan McCabe said he isn't too concerned about the drug testing.

Like many players, McCabe took exception to Pound's comments about NHL players and said he'd be surprised if there were any positive tests.

"I think we've got a pretty clean game here," McCabe said at the Leafs practice facility on Sunday. "I know for a fact (steroids) aren't (prevalent) in our league."

McCabe is a member of the taxi squad for Team Canada's entry at the Olympics in Turin, Italy, next month.

He says he's been very careful about what kind of supplements he takes because other Olympic athletes have inadvertently tested positive in the past after taking over-the-counter drugs.

"I take vitamins - that's it," he said. "I've got nothing to worry about."

Modano is a member of the U.S. Olympic team and says he was tested about six weeks ago.

He says that test does not have any penalties if it comes up positive, but that it serves to notify both athletes and Olympic officials of a potential problem.

"It's a good thing to know that if there's anything that's floating around, you can get it out of your system before the Games start," Modano said. "I think it's just a precautionary thing.

"When you do get in competition, if it is in there, then you've got some problems. We're well informed about what is good and what isn't good. The trainers know and everybody knows."

The NHL didn't have a drug policy until the league and the players agreed on one last summer as part of the new collective bargaining agreement.

The drug testing program wasn't activated until Sunday because the league and the NHL Players' Association wanted time to educate the players and teams' medical staffs on substance abuse.

Players will be tested randomly, up to twice a season, for prohibited substances such as anabolic steroids and growth hormones, but not stimulants such as ephedrine, which is found in some cold medications.
Souray says that's no big deal.

"I'm sure there are guys who take Sudafed, but it's probably no different than having three or four cups of coffee," he said. "If guys are on drugs because they're taking a pot of coffee a day, then there's going to be a lot of us."

Student Drug Addiction & Drug Testing Kits

The Carmel School Board will be asked Monday night to give staff direction on a proposed voluntary drug-testing program for students at Carmel High School and Carmel Valley Middle School.

The program is designed to do two things: get children and their parents to talk about drugs and give children a reason to say no.

Students and their parents must agree to opt in, so, parents can't force their children to enroll.
"By filling out the form, what we're trying to do is to encourage parents and students to have the conversation about drug and alcohol use in their family," said Carmel School District representative Paul Behan.

The program would be done at the school by an outside firm, and only the students and their parents would be given results of the tests. (continues below...)

Testing is done randomly and students can choose not to participate if they're selected, but their parents will be informed of their refusal.

The Carmel School Board will be asked to give district staff guidance on what kind of voluntary-testing program it might approve.

The program is modeled after a very successful program in San Clemente. That program found that even children who weren't in the program used it as a way to say no to drugs to their peers.
If approved, the voluntary drug-testing program would take effect next fall.

Earlier this season, Seattle forward Reggie Evans was late coming out of the locker room for the second half.
Why? He had been detained by the NBA's drug-testing agency, which demanded he submit one of the four mandated random tests.

That will be the last random test conducted during a game -- the agency overstepped its bounds there. But, it still does tests before and after games. Teams have complained the agency has asked for the tests as close as one hour before tip-off.

Under the league's collective bargaining agreement, all players not only have to give four random samples throughout the season, but the league and players' association also have the right to order a test whenever they have reasonable cause to do so.

Players who test positive have five days to request a re-test, which can be administered by a different laboratory. (continues below...)

Players who test positive for what is called a Drug of Abuse (which includes cocaine, heroin, LSD, codeine) will be dismissed from the league. Also, players will be dismissed if they are convicted or plead no contest to a crime involving the use or possession of those drugs.

The penalties are different for those testing positive for marijuana and performance-enhancing drugs.
First-time offenders get a 10-game suspension and have to attend a program. A second violation brings a 25-game suspension and more time in the program. Third offense -- a year suspension.

Upon the fourth strike, you are out of the league.
